These Terms of Service (the “Terms”) are a legal agreement between you and DevPlay (“DevPlay,” “we,” “our,” or “us”) governing your access to and use of our games, applications, websites (including devplay.mobi), and related products and services (together, the “Services”). These Terms also serve as the End User License Agreement (EULA) for our applications. Please read them carefully.
These Terms apply to every player who downloads, accesses or uses a DevPlay game or Service. If you use the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms. Additional rules, guidelines or terms may apply to specific games, features, events or promotions; where they do, they form part of these Terms and, in the event of a conflict, the specific terms control for that feature.
You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms. Our Services are not directed to children under 13, and we do not knowingly collect personal information from them. See our Privacy Policy for details.
Subject to your compliance with these Terms, DevPlay grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to download and use one copy of our applications on a device that you own or control, and to access the Services, solely for your personal, non-commercial entertainment.
For applications obtained through the Apple App Store, this license is a “Licensed Application” license granted subject to the Apple Licensed Application End User License Agreement. Where these Terms are more restrictive, these Terms apply. You may not: (a) copy, modify, or create derivative works of the Services; (b) reverse engineer, decompile or disassemble any part of the Services except to the extent permitted by applicable law; (c) rent, lease, lend, sell, sublicense or otherwise transfer the Services; or (d) remove any proprietary notices.
Some Services allow or require you to create an account or profile, or to sign in through a third-party platform. You agree to provide accurate information and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized use of your account. We may refuse, suspend or terminate accounts at our discretion, as described in Section 14.
Our games are generally free to download and play, and may offer optional in-app purchases, including consumable and non-consumable virtual items, in-game currency, and subscriptions (together, “In-App Purchases”). In-App Purchases are processed by the app store or platform through which you obtained the app (for example, the Apple App Store or Google Play), not directly by DevPlay. Your purchase is therefore also subject to the payment terms and policies of that platform.
To help prevent unwanted or accidental purchases, we recommend enabling password protection, Face ID / Touch ID, or purchase restrictions in your device settings, and using parental controls (such as Apple’s Screen Time / Ask to Buy or Google Play parental controls) on devices used by children.
Some Services offer auto-renewable subscriptions that provide access to premium content, features, or in-game benefits for a recurring fee. When you purchase a subscription, the following terms apply:

DevPlay cannot directly issue refunds for purchases made through an app store, but we want you to be treated fairly. If you were charged in error, experienced a technical problem that prevented you from receiving content you paid for, or believe a charge was unauthorized, contact us at [email protected] (choose the “Refund request” topic on our contact page) and we will do our best to help, including assisting your request with the relevant app store.
Except where required by applicable law (including mandatory consumer-protection or withdrawal rights in your jurisdiction), all sales are final, and virtual items and in-game currency are non-refundable and have no monetary value outside the game.
Games may include virtual currency, virtual goods, and other digital items (“Virtual Items”). Virtual Items are licensed, not sold, to you, and your license grants only a limited right to use them within the applicable game. Virtual Items:
We do not guarantee that any Virtual Item will be available for any specific length of time and may change, limit, or discontinue any Virtual Item at our discretion.

Some Services let you create, post, or share content such as usernames, messages, or profile information (“User Content”). You retain ownership of your User Content, but you grant DevPlay a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and use it as needed to operate and improve the Services. You are solely responsible for your User Content and represent that you have the rights to share it. We may remove any User Content that violates these Terms or applicable law.
The Services, including all games, software, artwork, characters, audio, text, logos, and trademarks, are owned by DevPlay or its licensors and are protected by intellectual-property laws. Except for the limited license granted to you in these Terms, no rights are transferred to you. “DevPlay” and our game titles and logos are trademarks of DevPlay and may not be used without our prior written permission.
The Services may include advertising and integrations with third parties (such as app stores, social networks, analytics providers, and advertising networks). Your use of third-party services is governed by their own terms and privacy policies, and we are not responsible for their content or practices. Advertising helps us keep many games free to play; you can learn about your advertising choices in our Privacy Policy.
You may request deletion of your account and associated personal data at any time. This puts you in control of your information and complements the rights described in our Privacy Policy.
We will process verified deletion requests within the time required by applicable law (typically within 30 days). Once your account is deleted, you may lose access to your progress, Virtual Items, and any active subscriptions. Note that canceling a subscription is separate from account deletion and must be done through your app store (see Section 6). Some information may be retained where necessary to comply with legal obligations, resolve disputes, prevent fraud, or enforce our agreements, as explained in our Privacy Policy.
You may stop using the Services at any time and may delete your account as described above. We may suspend or terminate your access to all or part of the Services, with or without notice, if you violate these Terms, if we are required to do so by law, or if we discontinue a game or feature. Upon termination, the licenses granted to you end and you must stop using the Services. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.
To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that any content or Virtual Items will always be available.
To the fullest extent permitted by law, DevPlay and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or Virtual Items, arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid to us (or through the applicable app store for our Services) in the 12 months before the event giving rise to the claim, or (b) USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless DevPlay and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, your User Content, or your violation of these Terms or applicable law.
These Terms are governed by the laws applicable at DevPlay’s principal place of business, without regard to conflict-of-laws principles, and subject to any mandatory consumer-protection laws of your country of residence. Before filing any claim, you agree to first contact us at [email protected] so we can try to resolve the matter informally. Nothing in this section deprives you of the protection of mandatory provisions of the law of the country where you live.
We may update these Terms from time to time. If we make material changes, we will provide notice through the Services or by other appropriate means and update the “Last updated” date above. Your continued use of the Services after the changes take effect constitutes acceptance of the updated Terms. If you do not agree, you should stop using the Services.
